An Act to amend the Dangerous Goods Act 1974
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Dangerous Goods Amendment Act 1989, and shall be read together with and deemed part of the Dangerous Goods Act 1974 (hereinafter referred to as the principal Act).
2 Interpretation
(1)
Section 2 of the principal Act is hereby amended—
(a)
By omitting from the definition of the term “Chief Inspector”
the words “Chief Inspector of Explosives under the Explosives Act 1957”
, and substituting the word “Secretary”
; and
(b)
By omitting from the definition of the terms “Inspector of Dangerous Goods”
or “Inspector”
, the words “Chief Inspector”
, and substituting the word “Secretary”
.
(2)
The principal Act is hereby consequentially amended by repealing section 6.
3 Delegation of powers of Secretary as Chief Inspector of Dangerous Goods
(1)
The principal Act is hereby amended by inserting, before section 7, the following section:
“6a
“(1)
Subject to subsection (2) of this section, the Secretary may delegate all or any of the Secretary’s powers as Chief Inspector as if they are powers of the Secretary as Secretary.
“(2)
The Secretary shall not delegate any of the Secretary’s powers as Chief Inspector except to a suitably qualified or experienced employee of the Department.”
(2)
The following enactments are hereby consequentially repealed:
(a)
Section 18a of the principal Act:
(b)
The Dangerous Goods Amendment Act 1975.
4 Inspectors of dangerous goods
The principal Act is hereby amended by repealing section 16, and substituting the following section:
“16
“(1)
There shall be appointed as Inspectors of Dangerous Goods a number of employees of the Department sufficient for the purposes of this Act.
“(2)
Every Inspector shall—
“(a)
Be under the direction of the Chief Inspector; and
“(b)
Within the district of a local licensing authority, supervise, and advise the authority’s inspectors.”
This Act is administered in the Department of Labour.
