An Act to amend the Education Act 1989

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Education Amendment Act (No. 3) 1990, and shall be read together with and deemed part of the Education Act 1989 (hereinafter referred to as the principal Act).

2 Payment of fees for attendance of children at kindergartens

(1)

The principal Act is hereby amended by inserting, after section 315, the following section:

“315a

“(1)

Fees may be charged in respect of the attendance, after the commencement of the Education Amendment Act (No. 3) 1990, of any child at any kindergarten (whether or not it is, or is known or described as, a free kindergarten) within the meaning of the Kindergarten Regulations 1959.

“(2)

Subsection (1) of this section is not limited or affected by, and shall have effect notwithstanding,—

“(a)

Any enactment or rule of law:

“(b)

Anything in the constitution of any body corporate:

“(c)

Any contract or undertaking to the contrary entered into or given before the commencement of the Education Amendment Act (No. 3) 1990.”

(2)

Regulation 14 of the Kindergarten Regulations 1959 is hereby consequentially revoked.
