Contents
An Act—
(a)
To issue and apply certain sums of public money for both the year ending with the 30th day of June 1990 and the quarter ending with the 30th day of June 1989; and
(b)
To authorise costs to be incurred, in relation to certain classes of outputs, for the year ending with the 30th day of June 1990; and
(c)
To appropriate the supply granted in both the year ending with the 30th day of June 1990 and the quarter ending with the 30th day of June 1989
MOST GRACIOUS SOVEREIGN,—We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand in Parliament assembled, towards making good the supply which we have cheerfully granted to Your Majesty in both this year and the transitional quarter, have resolved to grant unto Your Majesty the amounts hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted: And be it enacted by the Parliament of New Zealand as follows:
1 Short Title
(1)
This Act may be cited as the Appropriation Act 1990.
(2)
Part I of this Act relates to the year ending with the 30th day of June 1990 (hereinafter referred to as this year).
(3)
Part II of this Act relates to the quarter ending with the 30th day of June 1989 (hereinafter referred to as the transitional quarter).
Part I Appropriations in Respect of this Year
2 Interpretation
In this Part of this Act, unless the context otherwise requires,—
“Part A of the Adjusted Estimates” means Part A—Annual Appropriations, in relation to the Vote or Votes administered by each Department, in the Adjustments to Estimates of Annual Appropriations and Departmental Budgets of the Government of New Zealand for the year Ending 30 June 1990 (B. 7 [Vol. Ill]):
“Part A of the Estimates” means Part A—Annual Appropriations, in relation to the Vote or Votes administered by each Department, in the Estimates of Annual Appropriations and Departmental Budgets of the Government of New Zealand for the year Ending 30 June 1990 (B. 7 [Vol. I and Vol. II]):
“Amounts of public money”—
(a)
Means—
(i)
The amounts set out in bold type in Part A of the Estimates under the column headed 1989–90 Vote; and
(ii)
The amounts set out in bold type in Part A of the Adjusted Estimates under the column headed 1989–90 Vote or the column headed Adjustment to 1989–90 Vote; but
(b)
Does not include amounts for appropriations for classes of outputs under Mode B:
“Amounts of costs” means the amounts set out in bold type, in relation to appropriations for classes of outputs under Mode B,—
(a)
In Part A of the Estimates under the column headed 1989–90 Vote; and
(b)
In Part A of the Adjusted Estimates under the column headed 1989–90 Vote or the column headed Adjustment to 1989–90 Vote.
3 Appropriations of public money for programmes pursuant to Mode A
(1)
The Minister of Finance may issue and apply amounts of public money, for the purposes of the appropriations pursuant to Mode A enumerated in Column 4 of the First Schedule or in Column 4 of the Second Schedule to this Act, towards making good the supply granted to Her Majesty for the service of this year, which amounts include the sums of public money that have been issued and applied under the Imprest Supply Acts passed during this year.
(2)
The amounts of public money to which subsection (1) of this section relates are hereby separately appropriated for expenditure on the programme against which each amount is shown in the several Votes contained in the Estimates and as set out in Columns 2 and 4 of the First Schedule or in Columns 2 and 4 of the Second Schedule to this Act.
4 Appropriations for costs to be incurred for classes of outputs pursuant to Mode B
(1)
Subject to subsection (2) of this section, costs may be incurred in relation to the classes of outputs pursuant to Mode B enumerated in Column 5 of the First Schedule or in Column 5 of the Second Schedule to this Act.
(2)
For the purpose of meeting costs incurred under the authority of subsection (1) of this section, the Minister of Finance may issue and apply sums of public money towards making good the supply granted to Her Majesty for the service of this year, which sums include the sums of public money that have been issued and applied under the Imprest Supply Acts passed during this year.
(3)
The amounts of costs to which subsection (1) of this section relates are hereby separately appropriated for the class of outputs against which each amount is shown in the several Votes contained in the Estimates and as set out in Columns 2 and 5 of the First Schedule or in Columns 2 and 5 of the Second Schedule to this Act.
5 Appropriations of public money for benefits or grants
(1)
The Minister of Finance may issue and apply amounts of public money, for the purposes of the appropriations pursuant to Mode A and Mode B enumerated in Columns 6 and 7 respectively of the First Schedule to this Act and for the purposes of the appropriations pursuant to Mode A and Mode B enumerated in Columns 6 and 7 respectively of the Second Schedule to this Act, towards making good the supply granted to Her Majesty for the service of this year, which amounts include the sums of public money that have been issued and applied under the Imprest Supply Acts passed during this year.
(2)
The amounts of public money to which subsection (1) of this section relates are hereby separately appropriated for expenditure on the category of benefit or the grant against which each amount is shown in the several Votes contained in the Estimates and as set out in Columns 2, 6, and 7 of the First Schedule or in Columns 2, 6, and 7 of the Second Schedule to this Act.
6 Appropriations of public money for capital contributions
(1)
The Minister of Finance may issue and apply amounts of public money, for the purposes of the appropriations pursuant to Mode A and Mode B enumerated in Columns 8 and 9 respectively of the First Schedule to this Act and for the purposes of the appropriations pursuant to Mode A and Mode B enumerated in Columns 8 and 9 respectively of the Second Schedule to this Act, towards making good the supply granted to Her Majesty for the service of this year, which amounts include the sums of public money that have been issued and applied under the Imprest Supply Acts passed during this year.
(2)
The amounts of public money to which subsection (1) of this section relates are hereby separately appropriated for expenditure on the capital contribution against which each amount is shown in the several Votes contained in the Estimates and as set out in Columns 2, 8, and 9 of the First Schedule or in Columns 2, 8, and 9 of the Second Schedule to this Act.
7 Departments or Offices of Parliament changing to Mode B
The appropriations for classes of outputs, payments of benefits or grants, and capital contributions administered by each department or Office of Parliament, which is named in Column 1 of the Second Schedule to this Act and which has a date set out opposite its name in Column 10 of that Schedule, shall change from Mode A to Mode B on that date.
8 Expenditure of trading revenue for classes of outputs pursuant to Mode B
In respect of this year, costs may be incurred pursuant to section 10(1) of the Public Finance Act 1989, for the classes of outputs specified in the Third Schedule to this Act.
9 Transitional provision in respect of Department of Survey and Land Information and Department of Lands
Notwithstanding anything in the Public Finance Act 1989,—
(a)
In respect of this year, this Act shall, subject to paragraph (b) of this section, apply in relation to the Department of Survey and Land Information and the Department of Lands as if they constituted one Department; and
(b)
Any money or costs appropriated in respect of this year in the Vote Survey and Land Information may be expended or incurred not only in relation to the Department of Survey and Land Information but also as if the money or costs had been appropriated in relation to the Department of Lands.
10 Transitional provision in respect of Iwi Transition Agency and Iwi Transition Agency Establishment Unit
Notwithstanding anything in the Public Finance Act 1989,—
(a)
In respect of this year, this Act shall, subject to paragraph (b) of this section, apply in relation to the Iwi Transition Agency and the Iwi Transition Agency Establishment Unit as if they constituted one Department; and
(b)
Any money appropriated in respect of this year in the Vote Iwi Transition Agency may be expended not only in relation to the Iwi Transition Agency Establishment Unit but also as if the money had been appropriated in relation to the Iwi Transition Agency.
11 Transitional provision in respect of Iwi Transition Agency and Department of Maori Affairs
Notwithstanding anything in the Public Finance Act 1989,—
(a)
In respect of this year, this Act shall, subject to paragraph (b) of this section, apply in relation to the Iwi Transition Agency and the Department of Maori Affairs as if they constituted one department; and
(b)
Any money appropriated in respect of this year in the Vote Maori Affairs may be expended not only in relation to the Department of Maori Affairs but also as if the money had been appropriated in relation to the Iwi Transition Agency.
12 Financial statements to be prepared for Department of Maori Affairs and Iwi Transition Agency Establishment Unit
(1)
As soon as practicable after the 30th day of September 1989, the Iwi Transition Agency shall prepare financial statements for both the Department of Maori Affairs and the Iwi Transition Agency Establishment Unit for the period beginning on the 1st day of July 1989 and ending with the close of the 30th day of September 1989. The provisions of sections 35, 37, and 38 of the Public Finance Act 1989 shall apply to the financial statements for that period as if they were annual financial statements within the meaning of those sections.
(2)
The financial statements prepared under subsection (1) of this section shall be forwarded by the chief executive of the Iwi Transition Agency to the Responsible Minister for the Iwi Transition Agency, who shall lay a copy of them before the House of Representatives as soon as practicable after their receipt by the Minister.
13 Financial statements to be prepared for Department of Education
(1)
As soon as practicable after the 30th day of September 1989, the Ministry of Education shall prepare financial statements for the Department of Education for the period beginning on the 1st day of July 1989 and ending with the close of the 30th day of September 1989. The provisions of sections 35, 37, and 38 of the Public Finance Act 1989 shall apply to the financial statements for that period as if they were annual financial statements within the meaning of those sections.
(2)
The financial statements prepared under subsection (1) of this section shall be forwarded by the chief executive of the Ministry of Education to the Responsible Minister for the Ministry of Education, who shall lay a copy of them before the House of Representatives as soon as practicable after their receipt by the Minister.
Part II Appropriations in Respect of Transitional Quarter
14 Grant and appropriation of $5,906,318,000 out of Consolidated Account
(1)
Pursuant to the Imprest Supply Act 1989, the Minister of Finance caused to be issued and applied out of the Consolidated Account, towards making good the supply granted to Her Majesty for the service of the transitional quarter, a sum amounting to $5,906,318,000.
(2)
The sum to which subsection (1) of this section relates is hereby appropriated for the services and purposes expressed in the several votes specified in the Fourth Schedule to this Act.
15 Grant and appropriation of $170,987,000 out of Loans Account
(1)
Pursuant to the Imprest Supply Act 1989, the Minister of Finance caused to be issued and applied out of the Loans Account, towards making good the supply granted to Her Majesty for the service of the transitional quarter, a sum amounting to $170,937,000.
(2)
The sum to which subsection (1) of this section relates is hereby appropriated for the services and purposes expressed in the several votes specified in the Fifth Schedule to this Act.
16 Grant and appropriation of $52,000 out of accounts outside the Public Account
(1)
Pursuant to the Imprest Supply Act 1989, the Minister of Finance caused to be issued and applied out of the accounts outside the Public Account specified in the Sixth Schedule to this Act, towards making good the supply granted to Her Majesty for the service of the transitional quarter, a sum amounting to $52,000.
(2)
The sum to which subsection (1) of this section relates is hereby appropriated for the services and purposes expressed in the several votes specified in the Sixth Schedule to this Act.
Part III Miscellaneous Provisions
17 Unauthorised expenditure of $80,790,000 sanctioned
Whereas the Minister of Finance has, under the authority of section 55 of the Public Finance Act 1977, approved the expenditure during the year that ended with the 31st day of March 1989, in excess of or without the appropriation of Parliament, of the respective sums specified in the Seventh Schedule to this Act, out of the Consolidated Account amounting in the whole to the sum of $30,790,000: And whereas those sums have been issued and applied for the several services and purposes specified in that Schedule: Be it therefore enacted that the issue and application of those sums is hereby sanctioned.
18 Writing off of losses of public money and public stores amounting to $2,527,865,276
Whereas the losses of public money and public stores specified in the Eighth Schedule to this Act have occurred, amounting in the whole to $2,527,865,276: Be it therefore enacted that the amounts specified in that Schedule are hereby written off.
19 Repeals
The enactments specified in the Ninth Schedule to this Act are hereby repealed.
