Education Amendment Act (No 4) 1991: repealed, on 1 August 2020, pursuant to section 669(3)(b) of the Education and Training Act 2020 (2020 No 38).

An Act to amend the Education Act 1989

 
1 Short Title and commencement

(1)

This Act may be cited as the Education Amendment Act (No 4) 1991, and shall be read together with and deemed part of the Education Act 1989 (hereinafter referred to as the principal Act).

(2)

Except as provided in sections 5(5), 16(2), 17(2), 18(2), and 34 of this Act, this Act shall come into force on the 1st day of January 1992.

3 Foreign students

(1)

This subsection substituted section 4, and inserted sections 4A to 4D, of the principal Act.

(2)

This subsection amended the definition of the term exempt student in section 2(1) of the principal Act.

(3)

The following enactments are hereby consequentially repealed:

(a)

Sections 4(1), and 5(2) of the Education Amendment Act 1989:

(b)

Section 5(2) of the Education Amendment Act (No 2) 1991.

(4)

There shall be deemed to have been set under section 4D(1) of the principal Act (as substituted by subsection (1) of this section) the fee of $450 per student to be paid by Boards in respect of foreign students enrolled at state schools in 1992.

5 New Zealand citizens and residents between 6 and 16 to go to school

(1)

This subsection amended section 20(1) of the principal Act.

(2)

This subsection amended sections 7A(1)(a), 16 to 18, 28(2)(b), 30 and 31(4) of the principal Act.

(3)

(4)

Sections 20(1) and 30 of the principal Act (as amended, respectively, by subsections (1) and (2) of this section) shall apply to every person who—

(a)

Turned 15 in 1992; and

(b)

On or after turning 15, and before the commencement of this subsection, ceased to be enrolled at a state school; and

(c)

Has not since that commencement again enrolled at a state school,—

as if that person has turned 16.

(5)

Subsections (1) to (3) of this section shall come into force on the 1st day of January 1993.

9 National education guidelines

(1)

This subsection inserted section 60A of the principal Act.

(2)

This subsection amended section 60 of the principal Act.

(3)

This subsection substituted section 61(2) of the principal Act.

(4)

This subsection substituted section 61(12) of the principal Act.

(5)

All national education guidelines under section 60 of the principal Act that were in force immediately before the commencement of this Act shall continue in force as if they are national administration guidelines; but may be amended or revoked accordingly.

(6)

Section 6(2)(c) of the Education Amendment Act 1991 is hereby consequentially repealed.

12 Borrowing

(1)

This subsection substituted section 67 and inserted sections 67A and 67B of the principal Act

(2)

The following enactments are hereby consequentially repealed:

(a)

Section 18 of the Education Amendment Act 1990:

(b)

Section 4 of the Education Amendment Act (No 2) 1991.

19 Certain persons ineligible to be trustees

(1)

This subsection inserted section 103(1)(da) of the principal Act.

(2)

This subsection amended section 103(1)(e)(ii) of the principal Act.

(3)

This subsection inserted section 203(2A) of the principal Act.

(4)

No parent representative who, immediately before the commencement of this section, was a member of the Board staff shall go out of office by virtue of section 103(1)(da) of the principal Act (as inserted by subsection (1) of this section).
