An Act to amend the Selwyn Plantation Board Act 1953
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Selwyn Plantation Board Amendment Act 1991, and shall be read together with and deemed part of the Selwyn Plantation Board Act 1953.
2 Selwyn Plantation Board
(1)
Section 3 of the Selwyn Plantation Board Act 1953 is hereby amended as from the commencement of the 1st day of November 1989 by repealing subsection (2) (as substituted by section 2(1) of the Selwyn Plantation Board Amendment Act 1963), and substituting the following subsection:
“(2)
The Board shall consist of—
“(a)
Three members appointed by the Christchurch City Council:
“(b)
Three members appointed by the Selwyn District Council:
“(c)
One member being—
“(i)
In respect of the period beginning on the 1st day of November 1989 and ending with the 31st day of January 1990, the Commissioner of Crown Lands for the Canterbury Land District; and
“(ii)
As from the commencement of the 1st day of February 1990, the Commissioner of Crown Lands appointed under section 12a of the Survey Act 1986.”

Section 3 of the Selwyn Plantation Board Act 1953 ishereby amended as from the commencement of the 1st day of November 1989 by repealing subsections (5) and (6) (as addedby section 2(2) of the Selwyn Plantation Board Amendment Act 1963), and substituting the following subsections:
“(5)
When the whole district of a constituent authority ismerged in the district of another constituent authority as theresult of an Order in Council giving effect to a reorganisationscheme under the Local Government Act 1974, the number of members of the Board appointed by the constituent authoritywhose district is enlarged by the merger shall be increased bythe number of members previously appointed by theconstituent authority for the district so merged.
“(6)
Where a constituent authority is dissolved by an Orderin Council giving effect to a reorganisation scheme under the Local Government Act 1974, every member of the Boardappointed by the constituent authority so dissolved shall, unlessthat member’s office is vacated under section 6 of this Act, continue to hold office until any alteration of the constitution ofthe Board made necessary or advisable by the dissolution of theconstituent authority is effected by amendment to this Act, butnot in any case for a longer period than 12 months after thedate of the dissolution of the constituent authority.”
3 Meetings of the Board
Section 7(3) of the Selwyn Plantation Board Act 1953 is hereby amended as from the commencement of the 1st day of November 1989 by omitting the expression “seven”
, and substituting the expression “four”
.
4 Determination of interests of constituent authorities in plantation reserves
The Selwyn Plantation Board Act 1953 is hereby amended as from the commencement of the 1st day of November 1989 by repealing the First Schedule (as substituted by section 3 of the Selwyn Plantation Board Amendment Act 1963), and substituting the First Schedule set out in the Schedule to this Act.
5 Repeals
As from the commencement of the 1st day of November 1989, the following enactments are hereby repealed, namely,—
(a)
The Selwyn Plantation Board Amendment Act 1963:
(b)
Section 45 of the Local Legislation Act 1964:
(c)
Section 3(1) of the Reserves and Other Lands Disposal Act 1975.
