An Act to amend the Family Courts Act 1980
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Family Courts Amendment Act 1991, and shall be read together with and deemed part of the Family Courts Act 1980 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the 1st day of July 1992.
2 Jurisdiction
(1)
Section 11(1) of the principal Act is hereby amended by inserting, after paragraph (ga) (as inserted by section 449 of the Children, Young Persons, and Their Families Act 1989), the following paragraphs:
“(gb)
The Law Reform (Testamentary Promises) Act 1949:
“(gc)
The Family Protection Act 1955.”
(2)
Section 11 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1a)
A Family Court shall have jurisdiction to hear and determine any proceedings brought, pursuant to section 57(4) of the Matrimonial Property Act 1976, under the Matrimonial Property Act 1963.”
This Act is administered in the Department of Justice.
