An Act to amend the Accident Compensation Act 1982

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Accident Compensation Amendment Act (No. 2) 1991, and shall be read together with and deemed part of the Accident Compensation Act 1982 (hereinafter referred to as the principal Act).

2 Agent to pay levies to Corporation

(1)

The principal Act is hereby amended by repealing section 51 (as amended by section 32(1) of the State-Owned Enterprises Act 1986), and substituting the following section:

“51

“(1)

Subject to this section, where any levy is paid to an agent under this Part of this Act, the agent—

“(a)

May deduct from the amount so paid a collection fee at a rate fixed in accordance with section 17(4) of this Act; and

“(b)

Shall, not later than the end of the month following the month in which the payment is received, pay the balance of that amount to the Corporation.

“(2)

In the case of any levy received by the Secretary for Transport under this Part of this Act, the Secretary shall—

“(a)

Deduct from the amount of every levy so received a collection fee at a rate fixed in accordance with section 17(4) of this Act; and

“(b)

Not later than the end of the month following the month in which the payment is received, pay the balance to the Corporation without further appropriation than this section.

“(3)

In the case of any levy received on or after the 1st day of August 1991 by the Commissioner of Inland Revenue under this Part of this Act, the Commissioner shall, upon receipt of the levy, pay to the Corporation an amount equal to the amount of the levy less—

“(a)

A collection fee at a rate fixed in accordance with section 17(4) of this Act; and

“(b)

Any amount already paid to the Corporation under this Part of this Act before the 1st day of August 1991 in respect of the levy so received.

“(4)

Where—

“(a)

Any amount of levy payable by any person to the Commissioner of Inland Revenue is written off under section 114(7) of this Act, or is reduced by an assessment or amended assessment under section 45(1) of this Act; and

“(b)

The Commissioner has already paid an amount to the Corporation in respect of that levy (whether before, on, or after the 1st day of August 1991),—

the Commissioner may make an appropriate adjustment in any subsequent amount paid to the Corporation under subsection (3) of this section.

“(5)

For the purposes of this section, the term ‘levy’ includes any penalty payable under section 42(3) of this Act.”

(2)

The State-Owned Enterprises Act 1986 is hereby consequentially amended by repealing so much of the Third Schedule as relates to section 51(6) of the Accident Compensation Act 1982.

This Act is administered by the Accident Compensation Corporation.
