An Act to amend the Employment Contracts Act 1991
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Employment Contracts Amendment Act 1991, and shall be read together with and deemed part of the Employment Contracts Act 1991 (hereinafter referred to as the principal Act).
2 Existing documents
Section 176 of the principal Act is hereby amended by repealing subsection (5), and substituting the following subsection:
“(5)
For the purposes of any redundancy agreement to which subsection (4) of this section applies and for the purposes of any provisions relating to redundancy that are contained in any award or agreement to which subsection (1) or subsection (3) of this section applies, and for the purposes of any individual employment contract based, by virtue of the operation of section 19(4) of this Act, on any such redundancy agreement or any such provisions,—
“(a)
The term ‘redundancy’ shall, after the commencement of this section, have, subject to section 184a(1) of the Labour Relations Act 1987 (as inserted by section 20(1) of the Labour Relations Amendment Act 1990), the same meaning as it had immediately before the commencement of this section; and
“(b)
Section 184a(1) of the Labour Relations Act 1987 (as so inserted) shall, after the commencement of this section, continue to have effect as if it had not been repealed.”
