An Act to amend the Animals Protection Act 1960

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Animals Protection Amendment Act 1993, and shall be read together with and deemed part of the Animals Protection Act 1960 (hereinafter referred to as the principal Act).

2 Power to disqualify persons convicted of cruelty to animals

(1)

Section 16 of the principal Act is hereby amended by repealing subsection (1), and substituting the following subsection:

“(1)

A Court that—

“(a)

Convicts a person of an offence against section 4 of this Act or subsection (3) of this section; or

“(b)

Convicts of an offence against section 3 of this Act a person who has previously been convicted of an offence against that section or section 4 of this Act,—

may (in addition to or substitution for any other penalty) disqualify the person, for any period it thinks fit, from having custody or control of, or exercising authority in respect of, the animal, or any animal or animals of a particular kind or description.”

(2)

Section 16(3) of the principal Act is hereby consequentially amended by omitting the words “of any animal”, and substituting the words “or control of, or exercises authority in respect of, any animal, or any animal or animals of a particular kind or description,”.

3 Fines increased

(1)

The principal Act is hereby amended in the manner indicated in the Schedule to this Act.

(2)

Section 3 of the Animals Protection Amendment Act 1978 is hereby consequentially repealed.

Schedule Amendments to Principal Act

Section 3(1)

Section 6(2)	By omitting the expression “$200” (as substituted by section 3(c) of the Animals Protection Amendment Act 1978), and substituting the expression “$1,000”.
Section 7(3)	By omitting the expression “$1,000” (as substituted by section 3(d) of the Animals Protection Amendment Act 1978), and substituting the expression “$5,000”.
Section 8(3)	By omitting the expression “$50” (as substituted by section 3(e) of the Animals Protection Amendment Act 1978), and substituting the expression “$250”.
Section 10(7)	By omitting the expression “$100” (as substituted by section 3(f) of the Animals Protection Amendment Act 1978), and substituting the expression “$500”.
Section 16(3)	By omitting the expression “$1,000” (as substituted by section 3(g) of the Animals Protection Amendment Act 1978), and substituting the expression “$10,000”.
Section 17(2)	By omitting the expression “$100” (as substituted by section 3(h) of the Animals Protection Amendment Act 1978), and substituting the expression “$500”.
Section 18 (as amended by section 4 of the Animals Protection Amendment Act 1978)	By omitting the expression “$1,000”, and substituting the expression “$5,000”.
Section 19b (as inserted by section 6 of the Animals Protection Amendment Act 1988)	By omitting the expression “$1,000”, and substituting the expression “$5,000”.

This Act is administered in the Ministry of Agriculture and Fisheries.
