An Act to validate and confirm certain regulations made under the Primary Products Marketing Act 1953

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title

This Act may be cited as the Primary Products Marketing (Regulations Confirmation) Act 1993.

2 Act binds the Crown

This Act binds the Crown.

3 Regulations confirmed

The following regulations are hereby validated and confirmed:

(a)

The Kiwifruit Marketing Regulations 1977, Amendment No. 9:

(b)

The Kiwifruit Marketing Regulations 1977, Amendment No. 10.

4 Kiwifruit Marketing Regulations 1977 amended

(1)

The Kiwifruit Marketing Regulations 1977 are hereby amended, with effect from the commencement of the Kiwifruit Marketing Regulations 1977, Amendment No. 7, by revoking paragraph (c) of clause 23 of the Second Schedule (as substituted by regulation 11 of the Kiwifruit Marketing Regulations 1977, Amendment No. 4), and substituting the following paragraph:

“(c)

If the voter—

“(i)

Has voted for 2 or more candidates; but

“(ii)

Has not assigned votes to all candidates voted for by writing the digits ‘1’, ‘2’, ‘3’, etc., in the boxes next to their names on the voting paper; or”.

(2)

The Kiwifruit Marketing Regulations 1977 may be amended or revoked as if the amendment effected by subsection (1) of this section had been effected by Order in Council and not by that subsection.

5 Repeal

Section 3 of the Subordinate Legislation (Confirmation and Validation) Act 1992 is hereby repealed.

This Act is administered in the Ministry of Agriculture and Fisheries.
