An Act to amend the Harbours Act 1950
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Harbours Amendment Act 1993, and shall be read together with and deemed part of the Harbours Act 1950 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the day on which it receives the Royal assent.
2 Subject-matters of bylaws
(1)
Section 232 of the principal Act is hereby amended by inserting, after paragraph (37), the following paragraph:
“(37a)
Regulate the landing and mooring of aircraft within the limits of the harbour, the navigation and control of aircraft on the harbour, and the unmooring and departure of aircraft from the harbour:”.
(2)
Section 232 of the principal Act is hereby amended by inserting, after paragraph (41), the following paragraph:
“(41a)
Regulate and control, for the purposes of navigation and safety, the use or management of surfboards, the speed, use, anchoring, mooring, and management of vessels, and the towing by vessels of any kind of aquaplane, water skis, other similar objects, and persons. Bylaws under this paragraph may—
“(a)
Regulate or prohibit the use of any area for navigation and safety purposes; and
“(b)
Require any person alleged to have committed an offence against the bylaws to provide their name and address to a person appointed to any office (including an honorary office) specified in the bylaws:”.
This Act is administered in the Ministry of Transport.
