An Act to amend the Health Act 1956
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Health Amendment Act (No. 3) 1993, and shall be read together with and deemed part of the Health Act 1956 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the day on which it receives the Royal assent.
2 Nuisances defined for purposes of this Act
Section 29(ka) of the principal Act (as inserted by section 2 of the Health Amendment Act 1978) is hereby amended by omitting the words “is offensive or”
.
3 Restrictions on carrying on offensive trade
Section 54 of the principal Act is hereby amended by repealing subsection (7) (as substituted by section 56(1) of the Clean Air Act 1972), and substituting the following subsection:
“(7)
Nothing in this section relating to local authorities (including consents and registration) shall apply to any offensive trade where a resource consent for that activity has been granted under the Resource Management Act 1991.”
This Act is administered in the Ministry of Health.
