Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order brings sections 35 and 41 of the Electoral Amendment Act 2002 into force on 10 November 2003.

Section 35 of the Electoral Amendment Act 2002 inserts new sections 111A to 111F into the Electoral Act 1993. New sections 111A to 111F provide for—

• •the establishment and maintenance of registers of iwi affiliations made up of specified electoral information collected from Maori electors; and

• •the designation of a body to maintain those registers; and

• •the means by which information is to be collected for inclusion on the registers, including the seeking of consent from Maori electors to the supply of information to the designated body; and

• •the supply of information from the registers to iwi organisations and other Maori organisations for the purposes of those organisations.

Section 41 of the Electoral Amendment Act 2002 inserts a new section 117A into the Electoral Act 1993, which makes it an offence to misuse electoral information supplied under new section 111D of the Electoral Act 1993.
