An Act to amend the District Courts Act 1947
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the District Courts Amendment Act 1994, and shall be read together with and deemed part of the District Courts Act 1947 (hereinafter referred to as the principal Act).
2 Order for examination of judgment debtor
Section 84B of the principal Act (as inserted by section 9 of the District Courts Amendment Act 1989) is hereby amended by adding the following subsection:
“(6)
The jurisdiction of the District Court under this section may be exercised by the Registrar.”
3 Review of Registrar’s decision
Section 84N of the principal Act (as inserted by section 9 of the District Courts Amendment Act 1989) is hereby amended by inserting, after the word “under”
, the expression “section 84B or”
.
4 Payment and recovery of fees
Section 113 of the principal Act is hereby amended by inserting, after subsection (1), the following subsection:
“(1A)
The fact that the party on whose behalf any proceedings are taken is Her Majesty, or any officer of Her Majesty’s Government in New Zealand on Her Majesty’s behalf or on behalf of Her Majesty’s Government in New Zealand, shall not affect the application of subsection (1) of this section.”
