An Act to amend the Police Complaints Authority Act 1988
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Police Complaints Authority Amendment Act 1994, and shall be read together with and deemed part of the Police Complaints Authority Act 1988 (hereinafter referred to as the principal Act).
2 Action upon receipt of complaint
Section 17 of the principal Act is hereby amended by repealing subsection (2), and substituting the following subsections:
“(2)
Subject to subsection (2A) of this section, the Authority shall, as soon as practicable, advise the Commissioner and the complainant of the procedure it proposes to adopt under subsection (1) of this section.
“(2A)
Where—
“(a)
A complaint is made to the Police; and
“(b)
The Authority decides to adopt the procedure provided for in paragraph (a) or paragraph (b) or paragraph (c) of subsection (1) of this section; and
“(c)
The Authority is satisfied that the Police will inform the complainant of the procedure to be followed, — the Authority is not required to inform the complainant in accordance with subsection (2) of this section of the procedure it proposes to follow.”
3 Proceedings of Authority
Section 23 of the principal Act is hereby amended by adding the following subsection:
“(4)
Subject to the provisions of this Act, the Authority may regulate its procedure in such manner as it thinks fit.”
This Act is administered in the Department of Justice.
