An Act to amend the Transport Services Licensing Act 1989
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Transport Services Licensing Amendment Act 1995, and shall be read together with and deemed part of the Transport Services Licensing Act 1989 (hereinafter referred to as the principal Act).
(2)
This Act shall come into force on the day on which it receives the Royal assent.
2 Regional councils to consider contracting out functions under Act
Section 53a of the principal Act (as inserted by section 4 of the Transport Services Licensing Amendment Act (No. 2) 1992) is hereby amended by adding the following subsection:
“(5)
Notwithstanding any other provision of this section, any regional council referred to in subsection (1) of this section may, in accordance with section 37sc of the Local Government Act 1974 and without an appropriate competitive process under this section, transfer any of its functions, powers, and duties under this Act to any constituent authority that has no direct or indirect interest in any passenger service.”
3 Second Schedule amended
The Second Schedule to the principal Act is hereby amended by inserting in the appropriate columns opposite the item relating to the Transport Act 1962, in its appropriate numerical order, the following item:
| “69a(3) | Failure to comply with or contravening direction of enforcement officer | 25 | 25”. |
This Act is administered in the Ministry of Transport.
