An Act to amend the Local Government Official Information and Meetings Act 1987
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Local Government Official Information and Meetings Amendment Act 1996, and shall be read together with and deemed part of the Local Government Official Information and Meetings Act 1987 (hereinafter referred to as the principal Act).
2 Availability of agendas and reports
(1)
Section 46a(7) of the principal Act (as inserted by section 5 of the Local Government Official Information and Meetings Amendment Act 1991) is hereby amended by inserting, immediately before the words “Where an item”
, the words “Subject to subsection (7a) of this section,”
.
(2)
Section 46a of the principal Act (as so inserted) is hereby amended by inserting, after subsection (7), the following subsection:
“(7a)
Where an item is not on the agenda for a meeting,—
“(a)
That item may be discussed at that meeting if—
“(i)
That item is a minor matter relating to the general business of the local authority; and
“(ii)
The presiding member explains at the beginning of the meeting, at a time when it is open to the public, that the item will be discussed at the meeting; but
“(b)
No resolution, decision, or recommendation may be made in respect of that item except to refer that item to a subsequent meeting of the local authority for further discussion.”
This Act is administered in the Department of Internal Affairs.
