Pursuant to section 25 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Fisheries made in accordance with sections 25 and 25A of that Act, makes the following order.

1 Title

This order is the Fisheries (Amalgamation of Quota Management Areas) Order 2007.

2 Commencement

This order comes into force on 1 October 2007.

3 Amalgamation of quota management areas 5 and 6 relating to white warehou

Quota management areas 5 and 6 specified in relation to white warehou in the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 are altered by amalgamating them to create the quota management area 5B defined in Part 3 of Schedule 1 of the Fisheries Act 1996 for white warehou.

4 Part 3 of Schedule 1 of Fisheries Act 1996 amended

Part 3 of Schedule 1 of the Fisheries Act 1996 is amended by adding the item set out in the Schedule of this order.

5 Schedule of Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 consequentially amended

The item relating to white warehou in the Schedule of the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 is consequentially amended by omitting the items relating to quota management areas 5 and 6.

6 Savings

This order does not affect any proceedings commenced in relation to the quota management areas 5 and 6 referred to in clause 3 before they are amalgamated by that clause.

Quota management area WWA5B—Southland/Sub-Antarctic

All that area of New Zealand fisheries waters lying within fishery management areas 5 and 6.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order comes into force on 1 October 2007. It amalgamates quota management areas 5 and 6 specified in relation to white warehou in the Fisheries (Declaration of New Stock Subject to Quota Management System) Notice 1997 to create a new quota management area 5B. That notice is consequentially amended to omit the 2 original quota management areas 5 and 6, and the Fisheries Act 1996 is amended to describe the new quota management area 5B. The order does not affect any proceedings commenced in relation to quota management areas 5 and 6 before they are amalgamated.
