An Act to amend the Casino Control Act 1990
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Casino Control (Moratorium) Amendment Act 1997, and is part of the Casino Control Act 1990 (“the principal Act”
).
(2)
This Act comes into force on the day after the date on which it receives the Royal assent.
2 New heading and sections inserted
The principal Act is amended by inserting, after section 27, the following heading and sections:
“Moratorium
“27a Moratorium on considering applications received between 16 October 1997 and 15 October 2000
(1)
Subsection (2) applies to every application for a casino premises licence received by the Authority during the 3-year period commencing on 16 October 1997 and ending with the close of 15 October 2000.
“(2)
In relation to an application referred to in subsection (1), the Authority—
“(a)
Must not consider the application:
“(b)
Must not grant a licence in respect of the application:
“(c)
Must return the application, and any fee accompanying it, to the applicant as soon as practicable.
“(3)
The Authority may, in accordance with this Act, consider applications for, and grant, casino premises licences, if the applications are received by the Authority—
“(a)
Before 16 October 1997; or
“(b)
After 15 October 2000.
“(4)
The Crown is not liable to pay costs, compensation, or damages to a person—
“(a)
Who makes an application; or
“(b)
Who, but for this section, would have made an application—
for a casino premises licence to the Authority during the period commencing on 16 October 1997 and ending with the close of 15 October 2000.
“(5)
This section applies despite sections 28 to 31.
“27b Expiry of provisions
Section 27a and this section expire with the close of 15 October 2000.”
3 Repeal of Act
This Act is repealed on 16 October 2000.
This Act is administered in the Department of Internal Affairs.
