The Parliament of New Zealand enacts as follows:
1 Title
-
(1) This Act is the Personal Property Securities Amendment Act 2005.
(2) In this Act, the Personal Property Securities Act 1999 is called
“the principal Act”
.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Interpretation
Section 16(1) of the principal Act is amended by inserting, in its appropriate alphabetical order, the following definition:
“Court or court means the High Court of New Zealand.”
4 Search purposes, etc
Section 173(j) of the principal Act is amended by omitting the words
“court bailiff”
, and substituting the words“bailiff of the High Court of New Zealand or of any other court”
.
5 Application of sections 185 to 189
Section 184(a) of the principal Act is amended by omitting the words
“a court”
, and substituting the words“the High Court of New Zealand or in any other court”
.
