104 Exercise of powers, duties, and functions

(1)

The acknowledgement by section 102 does not affect, and may not be taken into account in, the exercise of a power, duty, or function by a person or entity under a statute, regulation, or bylaw.

(2)

No person or entity, in considering a matter or making a decision under a statute, regulation, or bylaw, may give greater or lesser weight to the association of Te Uri o Hau with indigenous species than that person or entity would give under the relevant statute, regulation, or bylaw, if no acknowledgement of that association existed.

Subsection (2) does not limit subsection (1).

This section applies subject to the other express provisions of this subpart.
