Contents
The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Cadastral Survey Amendment Act 2008.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Principal Act amended
This Act amends the Cadastral Survey Act 2002.
4 New section 34 substituted
Section 34 is repealed and the following section substituted:
“34 Interpretation
In this Part, unless the context otherwise requires,—
“licensed cadastral surveyor or cadastral surveyor includes a former licensed cadastral surveyor and a person who was a registered surveyor under the Survey Act 1986
“professional misconduct means the professional misconduct described in Schedule 2.”
5 Complaints of professional misconduct
Section 35(4) is amended by inserting
“or the chief executive”
after“the Surveyor-General”
.
6 Regulations
Section 48 is amended by inserting the following subsection after subsection (2):
“(2A) A cadastral surveyor must comply with regulations made under subsection (1) unless the chief executive has determined that it is impractical or unreasonable to provide or receive a cadastral survey dataset, or specified parts or classes of cadastral survey datasets, as digital cadastral survey datasets for the purposes of subsection (1).”
7 Correction of errors in survey

(1) Section 52(1) is amended by—
(a) inserting
“, or arrange to be undertaken,”
after“to undertake”
; and
(b) adding
“within a time that the Surveyor-General considers reasonable”
.
(2) Section 52 is amended by adding the following subsection:
“(3) In subsection (1), cadastral surveyor includes a former licensed cadastral surveyor and a person who was a registered surveyor under the Survey Act 1986.”
8 Schedule 2 amended
Clause 1(g) of Schedule 2 is amended by inserting
“or the chief executive”
after“the Surveyor-General”
.
