Electronic Transactions (Contract Formation) Amendment Act 2014: repealed, on 1 September 2017, pursuant to section 345(1)(e) of the Contract and Commercial Law Act 2017 (2017 No 5).

The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Electronic Transactions (Contract Formation) Amendment Act 2014.
2 Commencement
This Act comes into force on the day after the date on which it receives the Royal assent.
3 Principal Act
This Act amends the Electronic Transactions Act 2002 (the principal Act).
4 Section 4 amended (Overview)
In section 4(b), replace “13”
with “13A”
.
5 New section 13A inserted (Time of communication of acceptance of offer)
After section 13, insert:
13A Time of communication of acceptance of offer
(1)
For the purpose of the formation of a contract, an acceptance by electronic communication of an offer is taken to be communicated to the offeror at the time determined by section 11 to be the time of receipt for that electronic communication.
(2)
Subsection (1) does not apply if—
(a)
the parties to the contract otherwise agree; or
(b)
an enactment provides otherwise.
