102 Offence of breach of duty

(1)

A person commits an offence who, without reasonable excuse,—

(a)

being the operator of a wine standards management plan, breaches or fails to carry out any of the duties specified in section 13; or

(b)

being an exporter, breaches or fails to carry out any of the duties specified in section 40; or

(c)

being a recognised agency, breaches or fails to carry out any of the duties specified in section 82G; or

(d)

being a recognised person, breaches or fails to carry out any of the duties specified in section 82H.

(2)

A person who commits an offence under subsection (1) is liable on conviction to a fine not exceeding—

(a)

$100,000, in the case of a body corporate; or

(b)

$20,000, in the case of an individual.
