Functions, powers, and duties of Commissioner

11 Matters to which Commissioner must have regard in exercising functions or powers

In performing or exercising the Commissioner’s functions or powers under this Act, the Commissioner must have regard to the following matters:

(a)

the Convention:

(b)

the principle that the Commissioner should give serious consideration to the views of children and take those views into account:

(c)

the principle that the Commissioner should recognise the diversity of children in New Zealand:

(d)

the principles stated in sections 4A and 5 of the Oranga Tamariki Act 1989, so far as they are applicable and with all necessary modifications.
