The Parliament of New Zealand enacts as follows:
1 Title
This Act is the Evidence Amendment Act 2005.
This Act was repealed, as from 1 August 2007, pursuant to section 215 Evidence Act 2006 (2006 No 69). See clause 2(2) Evidence Act 2006 Commencement Order 2007 (SR 2007/190).
2 Commencement
(1)
Section 3 comes into force on a date to be appointed by the Governor-General by Order in Council.
(2)
The rest of this Act comes into force on the day after the date on which it receives the Royal assent.

3 Section 2 of Evidence Amendment Act 1994 amended
(1)
Section 2 of the Evidence Amendment Act 1994 is amended—
(a)
by omitting from the definition of Australian subpoena the words “criminal or a family”
, and substituting the word “specified”
; and
(b)
by omitting from the definition of New Zealand subpoena the words “criminal or a family”
, and substituting the word “specified”
; and
(c)
by repealing the definition of family proceeding.
(2)
Section 2 of the Evidence Amendment Act 1994 is amended by inserting, after the definition of prescribed, the following definition:
specified proceeding means a proceeding—
(a)
in respect of which a person is seeking an order under the Convention on the Civil Aspects of International Child Abduction signed at the Hague on the 25th day of October 1980; or
(b)
relating to the status or property of a person under a disability; or
(c)
that is a criminal proceeding
