The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Hazardous Substances and New Organisms Amendment Act 2007.

2 Commencement

This Act comes into force on the day after the date on which it receives the Royal assent.

3 Principal Act amended

This Act amends the Hazardous Substances and New Organisms Act 1996.

4 Powers, functions, and duties of Authority

(1) Section 11(1) is amended by renumbering paragraph (fb) (as inserted by section 7(1) of the Hazardous Substances and New Organisms Amendment Act 2003) as paragraph (fc).

(2) Section 11 is amended by renumbering subsection (2) (as inserted by section 200 of the Crown Entities Act 2004) as subsection (3).

5 Requirements for containers, identification, disposal, emergencies, tracking, and fireworks

Section 76 is amended by repealing subsection (4) and substituting the following subsection:
- “(4) Despite section 18(1) of the Building Act 2004, regulations may be made prescribing requirements for stationary containers that require a person to achieve performance criteria that are additional to or more restrictive in relation to any building work than the performance criteria specified in the building code as defined in section 7 of the Building Act 2004.”

6 Pecuniary penalty order

Section 124B(2)(b) is amended by omitting “manufactured,”.

7 Civil liability

Section 124G(1)(b) is amended by omitting “manufactured,”.

8 Regulations

Section 140(1)(k) is amended by inserting “38A,” after “34,”.
