Pursuant to sections 167 and 168 of the Land Transport Act 1998, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following regulations.

Regulations
1 Title and commencement
(1)
These regulations may be cited as the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.
(2)
These regulations come into force on 3 May 1999.
2 Interpretation
(1)
In these regulations, unless the context otherwise requires,—
the Act means the Land Transport Act 1998
Driver Licensing rule, means the Land Transport (Driver Licensing) Rule 1999 (Land Transport 91001)
large passenger service vehicle has the same meaning as it has in section 2(1) of the Land Transport Act 1998
overseas licence means an overseas driver licence or permit that authorises the holder to drive a class or classes of motor vehicle in New Zealand
small passenger service vehicle has the same meaning as it has in section 2(1) of the Land Transport Act 1998
Type D, in relation to an endorsement, means a dangerous goods endorsement
Type F, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that is a forklift
Type I, in relation to an endorsement, means a driving instructor endorsement
Type O, in relation to an endorsement, means a testing officer endorsement
Type P, in relation to an endorsement, means a passenger endorsement
Type R, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on rollers
Type T, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on self-laying tracks
Type V, in relation to an endorsement, means a vehicle recovery endorsement
Type W, in relation to an endorsement, means an endorsement authorising the driving of a special-type vehicle that runs on wheels but is not a forklift.
(2)
In these regulations, a reference to a specified class of driver licence is a reference to that class of driver licence as defined in the Driver Licensing rule.

3 Applications to obtain or renew certain driver licences
(1)
An application for the issue or renewal of a driver licence must be accompanied by—
(a)
the appropriate application fee or fees specified in Part 1 of the Schedule; and
(b)
the appropriate fee or fees, if any, specified in Part 4 of the Schedule in respect of the driver test or tests that the applicant will be required to undertake.
(2)
This regulation does not apply to—
(a)
an application for an endorsement of a driver licence or a renewal of an endorsement:
(b)
an application for the issue of a alcohol interlock licence, zero alcohol licence, or limited licence:
(c)
an application for the issue of a replacement licence in circumstances where regulation 9(1) applies:
(d)
an application for a New Zealand driver licence by the holder of an overseas driver licence in circumstances where regulation 10 applies.

4 Application for endorsement of driver licences
An application for the issue of an endorsement of a driver licence must be accompanied by—
(a)
the appropriate application fee specified in Part 2 of the Schedule; and
(b)
the appropriate fee or fees, if any, specified in Part 4 of the Schedule in respect of the driver test or tests that the applicant will be required to undertake; and
(c)
the appropriate fit and proper person checking fee, if any, described in regulation 6.

5 Applications for renewal of endorsements
(1)
An application for the renewal of an endorsement of a driver licence must be accompanied by—
(a)
the appropriate application fee specified in Part 3 of the Schedule; and
(b)
the appropriate fit and proper person checking fee, if any, described in regulation 6.
(2)
Despite subclause (1)(a), an applicant for the renewal of 2 or more endorsements of Type I, O, P, or V is required to pay 1 application fee in respect of those applications for renewal (being the higher or highest application fee specified in Part 3 of the Schedule for one of those endorsements for which renewal is sought).

6 Other fees payable by applicant for or holder of endorsement
(1)
An applicant for a Type I, O, P, or V endorsement who does not already hold a Type I, O, P, or V endorsement must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.
(2)
If the holder of a Type P endorsement issued only for the purpose of driving large passenger service vehicles applies for a Type I, O, or V endorsement, or a Type P endorsement to be issued for the purpose of driving small passenger service vehicles or both large and small passenger service vehicles, the applicant must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.
(3)
Despite subclauses (1) and (2), an applicant to whom subclause (1) or subclause (2) applies, who applies for 2 or more endorsements of Type I, O, P, or V, is required to pay 1 fit and proper person checking fee in respect of those applications (being the higher or highest of the applicable fit and proper person checking fees specified in Part 5 of the Schedule for one of those endorsements sought to be issued).
(4)
An applicant for a renewal of a Type I, O, P, or V endorsement must pay the appropriate fit and proper person checking fee specified in Part 5 of the Schedule.
(5)
Despite subclause (4), an applicant for the renewal of 2 or more endorsements of Type I, O, P, or V is required to pay 1 fit and proper person checking fee in respect of those applications for renewal (being the higher or highest of the applicable fit and proper person checking fees specified in Part 5 of the Schedule for one of those endorsements for which renewal is sought).

7 Fees for alcohol interlock licence, zero alcohol licence, and limited licence
(1)
If an order is made that authorises a person to apply for an alcohol interlock licence under section 65AC of the Act, the person to whom the licence is issued must pay to the Agency the appropriate fee specified in Part 7 of the Schedule.
(2)
If an order is made that authorises a person to apply for a zero alcohol licence under section 65AC(2)(d), 65AI(c), or 100B(2)(b) of the Act, the person to whom the licence is issued must pay to the Agency the appropriate fee specified in Part 7 of the Schedule.
(3)
If an order is made for the issue of a limited licence under section 105 of the Act, the person to whom the licence is issued must pay to the Agency the appropriate fee specified in Part 7 of the Schedule.

8 Fee for driver identification card
An application for the issue or renewal of a driver identification card must be accompanied by the appropriate fee specified in Part 7 of the Schedule.
9 Replacement licence or driver identification card
(1)
An application for a new driver licence to replace a driver licence, where clause 74(2) of the Driver Licensing rule applies, must be accompanied by the appropriate fee specified in Part 7 of the Schedule.
(1A)
The fee payable by the chief executive of the Ministry of Justice for a replacement photographic driver licence, if section 91G(5) or 91H(4) of the Act applies, is the appropriate fee specified in Part 7 of the Schedule.
(2)
An application for a new driver identification card to replace a driver identification card, where clause 74(2) of the Driver Licensing rule applies, must be accompanied by the appropriate fee specified in Part 7 of the Schedule.

10 Conversion of overseas licence
An application by a holder of an overseas licence for a New Zealand driver licence that would authorise the holder to drive the same class or classes of vehicle as is authorised by the overseas licence, must be accompanied by the fee specified in Part 7 of the Schedule.
11 Course provider approvals
An application for approval to run courses approved under the Driver Licensing rule must be accompanied by the appropriate fee specified in Part 8 of the Schedule.
12 Course approval
An application for the approval of a course under the Driver Licensing rule must be accompanied by the appropriate fee specified in Part 8 of the Schedule.
12A Fees to take part in accelerated licensing process
An application to take part as a driver or as an employer in the accelerated licensing process under Part 4A of the Driver Licensing rule must be accompanied by the appropriate fee specified in Part 8A of the Schedule.

13 Information requests
An application under section 199(4) or (6) of the Act for information stored in the national register of driver licences must be accompanied by the appropriate fee specified in Part 9 of the Schedule in respect of each person named in the application.
14 Exemptions
An application for an exemption from a requirement of the Driving Licensing rule must be accompanied by the fee specified in Part 10 of the Schedule.
14A Rescheduling driver test
(1)
An application to reschedule a driver test (including a test undertaken to obtain an endorsement of a licence) must be accompanied by the fee specified in Part 10A of the Schedule.
(2)
The applicant must make the application on a working day that leaves, after that working day, 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur.

15 Refunds
(1)
Subclause (2) applies to an applicant who—
(a)
makes—
(i)
an application for the issue or renewal of an endorsement of 1 of Type I, O, P, or V; or
(ii)
applications for the issue or renewal of an endorsement of 2 or more of Type I, O, P, or V; and
(b)
pays the fee or fees prescribed for the application or applications; and
(c)
may or may not pay a fit and proper person checking fee; and
(d)
has—
(i)
the application declined; or
(ii)
all the applications declined.
(2)
The applicant is entitled to the following:
(a)
the appropriate refund specified in Part 11 of the Schedule minus the refund processing fee also specified in that Part; and
(b)
if the applicant paid a fit and proper person checking fee, a refund of the proportion of the fee relating to vetting not undertaken.
(3)
Subclause (4) applies to an applicant who—
(a)
makes applications for the issue or renewal of an endorsement of 2 or more of Type I, O, P, or V; and
(b)
pays the fees prescribed for the applications; and
(c)
may or may not pay a fit and proper person checking fee; and
(d)
has 1 or more of the applications granted.
(4)
The applicant is not entitled to any refund for any of the applications that were declined.
(5)
Subclause (6) or (7) applies to an applicant who—
(a)
applies for a driver licence or an endorsement of a licence; and
(b)
pays the fee prescribed for a driver test; and
(c)
gives notice of his or her intention to withdraw from the test.
(6)
If the applicant gives the notice on a working day that leaves, after that working day, 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur, the applicant is entitled to a refund of the fee paid minus the refund processing fee specified in Part 11 of the Schedule.
(7)
If the applicant gives the notice on a working day that leaves, after that working day, fewer than 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur, the applicant is entitled to a refund of the fee paid minus the refund processing fee specified in Part 11 of the Schedule only if the time scheduled for the test is reallocated to another applicant.
(8)
If the Agency is satisfied in a particular case that there are special circumstances applicable to the case, it may waive, refund, or rebate a fee prescribed in these regulations or assessed under them.

16 Fees inclusive of GST
The fees prescribed by or assessed under these regulations are inclusive of goods and services tax.
17 Payment for medical examination
The fee to be paid by a person required to undertake a medical examination under the Driver Licensing rule is a reasonable fee fixed by the person who undertakes the examination.

Pursuant to sections 167 and 168 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Land Transport (Driver Licensing and Driver Testing Fees) Amendment Regulations 2011.
2 Commencement
(1)
Regulations 3, 5(1) to (3), and 6 come into force on 27 February 2012.
(2)
The rest of these regulations come into force on 1 October 2012.
3 Principal regulations amended
These regulations amend the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.
Transitional provision
6 Transitional provision relating to certain driver testing fees
(1)
This regulation applies to an applicant who—
(a)
makes an application to undertake a test to which a fee specified in item 2, 3, or 5 of Part 4 of the Schedule (as substituted by regulation 5(1) to (3) of these regulations) applies before 27 February 2012; but
(b)
does not sit the test to which the application relates until on or after 27 February 2012.
(2)
The applicant must pay the relevant fee that applies on the date on which the applicant sits, or intends to sit, the test.

1 General
This is a consolidation of the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
