Pursuant to section 2(1) of the New Zealand Public Health and Disability Amendment Act 2010, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the New Zealand Public Health and Disability Amendment Act 2010 Commencement Order 2011.
2 Commencement of specified sections of New Zealand Public Health and Disability Amendment Act 2010
Sections 4(1), 5(1), 8(2) and (3), 10 to 15, 22, 23, and 27 of the New Zealand Public Health and Disability Amendment Act 2010 come into force on 24 February 2011.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings into force specified provisions of the New Zealand Public Health and Disability Amendment Act 2010 (the Act) on 24 February 2011. The provisions that are brought into force—
enable the Minister to give directions to a DHB on how administrative, support, and procurement services should be obtained (sections 8(3) and 14); and
enable the Minister to give directions to all DHBs for the purpose of supporting Government policy on improving the effectiveness and efficiency of the public health and disability sector (sections 8(3) and 14); and
establish a new planning framework for DHBs (which requires the Minister to direct every DHB to prepare a plan for each financial year and enables the Minister to further direct DHBs to prepare or contribute to 1 or more other plans (sections 4(1), 5(1), 8(2) and (3), 10 to 13, 15, 22, and 27)); and
enable regulations to be made relating to the form, content, and procedural requirements of those plans (section 23(1)); and
enable regulations to be made prescribing rules for the resolution of disputes by mediation or arbitration (section 23(2)).

1 General
This is a consolidation of the New Zealand Public Health and Disability Amendment Act 2010 Commencement Order 2011 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
