261 Commission of infringement offences

(1)

A person who is alleged to have committed an infringement offence (other than an offence against section 259) may either—

(a)

be proceeded against for the alleged offence by the filing of a charging document under the Criminal Procedure Act 2011; or

(b)

be served with an infringement notice as provided for in section 262.

(2)

A person who is alleged to have committed an offence against section 259 may be served with an infringement notice as provided for in section 262.
