Pursuant to section 48 of the Conservation Act 1987, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Regulations
1 Title and commencement
(1)
These regulations may be cited as the Fish and Game Council Elections Regulations 1990.
(2)
These regulations shall come into force on the 28th day after the date of their notification in the Gazette.
2 Interpretation
(1)
In these regulations, unless the context otherwise requires,—
the Act means the Conservation Act 1987
election means election of members of a Fish and Game Council
extraordinary vacancy means a vacancy in the membership of a Fish and Game Council as a result of removal from office, discharge of the Council, resignation, or death
fish and game region means a region defined by notice in the Gazette pursuant to section 26A(1)(c) of the Act; and includes all alterations to the boundaries of the region that are for the time being in force
licence means an adult whole season licence that entitles the licence holder to hunt game or fish for sports fish
roll means any list made in the manner provided in these regulations that contains the names of persons entitled to vote at an election
subregion means any subdivision of a fish and game region as determined and notified by a Fish and Game Council under section 26U(3) of the Act
working day means a day of the week other than—
(a)
a Saturday, a Sunday, Waitangi Day, Good Friday, Easter Monday, Anzac Day, the Sovereign’s birthday, Te Rā Aro ki a Matariki/Matariki Observance Day, and Labour Day; and
(b)
if Waitangi Day or Anzac Day falls on a Saturday or a Sunday, the following Monday; and
(c)
a day in the period commencing on 20 December in any year and ending with 15 January in the following year.
(2)
Every reference in these regulations to the New Zealand Fish and Game Council or a Fish and Game Council shall, in relation to the first election of any Fish and Game Council, be read as a reference to the Transitional New Zealand Fish and Game Council or a Transitional Fish and Game Council, as the case may require.

3 Returning officer
(1)
There shall be a returning officer for every election of a Fish and Game Council under the Act.
(2)
The returning officer shall be the Manager of the Fish and Game Council for the region where the election is held or such other person as the Council may designate to be the returning officer.
(3)
The returning officer shall not be a candidate in the election for which he or she is the returning officer or be a member of the Fish and Game Council in respect of which the election is being held.
4 Indication on licence of desire to participate in election
(1)
Following the first election, every adult whole season licence to fish for sports fish or hunt game shall have a panel to be retained in the licence book on which the licence holder—
(a)
shall record his or her name and address; and
(b)
may indicate his or her desire to vote in the next election by signing in the appropriate place on the panel.
(2)
All licence books shall be retained by licence agents until collected by the local Fish and Game Council.
5 Returning officer to prepare rolls
(1)
Each returning officer shall prepare a roll of persons who are eligible to vote at the election pursuant to section 26Y(1) of the Act and who have, at least 1 calendar month before the election is held, chosen to participate in the election.
(2)
Any person who, at the time of purchasing an adult whole season licence, did not indicate his or her wish to vote at the next election, shall be enrolled if he or she provides satisfactory proof of holding a licence.
(3)
Rolls shall be in the form set out in Schedule 1.
6 Returning officer’s duties
(1)
Each returning officer shall ensure that—
(a)
the names on the roll are in alphabetical order:
(b)
the roll closes 1 calendar month before the date of the election:
(c)
the roll has been completed.
(2)
Before sending out voting papers, the returning officer shall ensure that a certificate signed by him or her to the effect that the roll has been duly compiled is attached to the roll.
(3)
Once a roll has been completed and certified it shall not be amended for any reason before the conduct of the election for which it has been compiled, except where the returning officer is satisfied that the elector is dead in which case the returning officer shall remove the name of the elector from the roll.
7 Inspection of rolls
Before and after it closes, every roll shall be open to inspection, in the presence of a person authorised by the Fish and Game Council concerned, at the regional office of the Council.
8 Notice of election
(1)
At least 60 days before any election, each returning officer shall, by public notice in all major daily newspapers circulating in his or her fish and game region, state the intention to hold an election and the date of the election, and call for eligible persons to put forward their names as candidates. The notice shall specify the following:
(a)
the place where the roll is held:
(b)
the fact that the roll is open to inspection:
(c)
the place where candidacy forms may be obtained:
(d)
the day and time by which candidates’ names are to be received by the returning officer, which date shall be no later than 40 days before the election:
(e)
the requirement that candidates insert their biographical details in words of not more than 250 into the candidacy forms:
(f)
the subregions:
(g)
the requirement that the candidates specify the subregion for which they wish to be elected:
(h)
the number of members to be elected:
(i)
the day and hour the poll closes.
(2)
The public notice shall also specify the qualifications a person must have to be entitled to vote at the election. It shall state that those who have not already indicated their intention to vote in the election may, up to 1 calendar month before the date of the election, advise the returning officer of their desire to vote, and, subject to satisfactory proof of purchase of a licence, they shall be entered on the roll.
9 Candidates
(1)
All eligible persons who wish to stand for election shall indicate their intention in the form specified in Schedule 2, and that form shall be signed by the candidate and submitted to the returning officer within the period specified in regulation 8(1). To be eligible to stand for election, the candidate must hold a current adult whole season licence to hunt game or fish for sports fish.
(2)
Candidates shall state on their candidacy form the subregion for which they wish to be elected.
(3)
No candidates shall have their election campaign subsidised or supported in any way from Fish and Game Council funds. The payment by Councils of the costs of publishing a candidate’s biographical details does not constitute such a subsidy or support.
10 Voting papers
(1)
At least 18 days before the date of the election, the returning officer shall forward to each person who is recorded on the roll, by posting to the person at the address appearing on the roll, a printed voting paper in the form specified in Schedule 3.
(2)
The voting paper shall contain—
(a)
the names of all candidates for each subregion, in alphabetical order of their surnames or family names; and
(b)
the name of the subregion for which each candidate wishes to be elected; and
(c)
an envelope addressed to the returning officer and inscribed with the words “Voting Paper”
; and
(d)
an information sheet containing any biographical details supplied by candidates.
(3)
Every person whose name appears on the roll for any fish and game region shall be entitled to exercise 1 vote at every election taken under these regulations for which that roll is used.
11 Return of voting papers to returning officer
(1)
After the elector has exercised his or her vote, the elector shall enclose the voting paper in the envelope addressed to the returning officer, taking care to ensure that only his or her own voting papers are included in that envelope, and shall by hand or by post deliver that envelope to the returning officer.
(2)
For the purposes of this regulation, delivery into the private receiving box or private mail bag of the returning officer at a New Zealand Post outlet or agency shall be deemed delivery to the returning officer, but any other delivery to a New Zealand Post outlet or agency, or delivery to any other person, shall not be deemed delivery to the returning officer.
(3)
On election day, the returning officer shall keep his or her office open until the close of voting to enable envelopes containing voting papers to be handed to him or her.
12 Invalid votes
(1)
A vote is invalid, and shall not be counted, if—
(a)
the voter votes more than once in the election; or
(b)
the voter votes for more candidates than there are members to be elected; or
(c)
in the opinion of the returning officer, the voting paper does not clearly indicate the candidate for whom the voter intended to vote; or
(d)
the returning officer believes on reasonable grounds that the voting paper was not issued to the voter by the returning officer.
(2)
A vote is invalid and shall not be counted unless the returning officer receives the voting paper,—
(a)
in the case of a vote delivered by hand, not later than 5 pm on the day of the election:
(b)
in the case of a postal vote, not later than 5 pm on the day 2 working days after the date of the election.
(3)
Every vote that is deemed invalid shall be enfaced with the date and time of receipt and the reason for invalidation, and may be destroyed after 3 months from the date of the election.
13 Candidate may withdraw
A candidate for election to a Fish and Game Council may withdraw from the election by written notice to the returning officer. If any candidate withdraws or dies after voting papers have been printed and before the date of the election, any votes given for that candidate shall be disregarded.
14 Scrutineers
(1)
Two scrutineers shall be appointed by the Fish and Game Council. They shall be persons who are not themselves standing for election to the Fish and Game Council, and have no personal involvement with any of the candidates either as relatives or business partners or otherwise.
(2)
It is not necessary for the scrutineers themselves to be in possession of a licence to hunt game or fish for sports fish.
15 Counting of votes
(1)
The returning officer shall, before the fifth working day after the second working day after the date of the election and in the presence of the 2 scrutineers, examine and open the envelopes, examine the voting papers, and count the valid votes.
(2)
After counting the valid votes, the returning officer shall, in the presence and hearing of the 2 scrutineers, from the envelopes delivered to him or her, conduct a scrutiny of the roll by drawing on a copy of the roll (hereinafter called the master roll) a line in pencil or ink through the number and name of every elector who appears to have voted.
(3)
The scrutiny of the roll may be carried out by mechanical or electronic means in the presence of the returning officer and scrutineers.
(4)
If, from the marking of the master roll and after such inquiry as the returning officer thinks necessary, it appears that any person has voted more than once at the election, the returning officer shall, in the presence of the scrutineers, extract the voting papers on which the number corresponding to the name of that person appears and, taking care to ensure that the voting papers so extracted are so covered that the votes recorded thereon are not seen by any person present, shall disallow every vote appearing to have been given by means of the voting papers so extracted.
(5)
The highest polling candidate for each subregion shall be considered successful and the remaining number shall be made up from the highest polling of all the other candidates.
16 Tied polls
Where, because each of 2 or more candidates has received the same number of valid votes, the returning officer cannot ascertain which of them has been elected, the matter shall be decided by lot in the presence of the 2 scrutineers.
17 Declaration of result
(1)
Forthwith after ascertaining which candidate or candidates have been elected, the returning officer shall sign a certificate declaring the result of the election. The 2 scrutineers shall also sign the certificate. The returning officer shall then notify in writing the election result to all candidates.
(2)
Within 7 working days of the signing of the certificate the returning officer shall arrange for public notification, in all major daily newspapers circulating in the Fish and Game Region, of the names of the members elected and declaring them elected to the Fish and Game Council.
18 Recounts
(1)
Where any candidate has reason to believe that the declaration by the returning officer of the number of votes received by any candidate is incorrect, and that on a recount thereof the first-mentioned candidate might be found to be elected, he or she may within 3 working days after the first public notification of the election results apply to the New Zealand Fish and Game Council for a recount.
(2)
Unless it is satisfied that the application is frivolous or vexatious, the New Zealand Fish and Game Council shall appoint an officer of the Council to conduct a recount and such officer shall be the same officer or one of the officers appointed to oversee the election under regulation 23.
(3)
The officer conducting the recount shall—
(a)
cause the recount to be commenced within 3 working days after the application is received; and
(b)
give notice in writing to the returning officer, the scrutineers, and to each of the candidates of the time and place at which the recount will be made.
(4)
The recount shall so far as practicable be made in the manner provided in the case of the original count.
(5)
No person shall be present at the recount except—
(a)
the officer appointed to conduct the recount; and
(b)
the assistants (if any) appointed by the officer conducting the recount; and
(c)
the returning officer and the assistants (if any) of the returning officer; and
(d)
the scrutineers.
(6)
The returning officer conducting the recount shall have all the powers that the returning officer had on the original count.
(7)
If on the recount the officer conducting the recount finds that the declaration of the result was incorrect, the officer shall inform the returning officer of the correct result, and the returning officer shall—
(a)
amend and sign the certificate provided under regulations 17(1); and
(b)
give public notification of the amended declaration in the manner provided in regulation 17(2).
19 Duties of returning officer, scrutineer, and persons assisting
Every returning officer, scrutineer, and other person assisting such persons shall faithfully and impartially perform the duties of that office and shall not, directly or indirectly,—
(a)
before signing the certificate required under regulation 17(1), make known the state of the poll or give or pretend to give any information by which the state of the poll might be known; or
(b)
make known for which candidate any person has voted; or
(c)
give any person any information likely to defeat the secrecy of an election.
20 Assumption of office
(1)
For the first election elected members of the Fish and Game Council shall be deemed to assume office on 4 May 1991.
(2)
In the case of a triennial election after the first election, elected members of the Fish and Game Council shall assume office on the day 10 working days after the date on which the returning officer signs the certificate declaring the results of the election or when declared to be elected under regulation 21.
(3)
In any other case members shall come into office on the day next after the day on which they are declared to be elected, or, as the case may require, at the time when the member is appointed to fill an extraordinary vacancy.
21 Postal ballot not necessary in certain cases
Where, at the close of the day specified for the receipt of candidates’ names in accordance with regulation 8(1)(d), the number of persons standing for election for the Fish and Game Council does not exceed the number of vacancies to be filled, the returning officer shall, in accordance with regulation 17, declare the existing candidate or candidates to be duly elected to the office or offices to be filled at the election being held and a postal vote shall not be conducted.
22 Voting papers to be sealed up
Forthwith after declaring the results of an election, the returning officer shall seal up the voting papers and—
(a)
shall not open them unless a recount is conducted under regulation 18; and
(b)
shall keep them at the regional office of the Fish and Game Council for 3 months; and
(c)
shall then destroy them.
23 Persons to oversee elections
The New Zealand Fish and Game Council may appoint an officer or officers to oversee the conduct of any or all Fish and Game Council elections.
24 Extraordinary vacancies
(1)
Where an extraordinary vacancy occurs or extraordinary vacancies occur, the Fish and Game Council concerned shall publish in all major daily newspapers circulating in its region a notice to inform the public of the vacancy or vacancies and that an election will only be called if requested by a majority of the eligible voters.
(2)
The election shall be held in accordance with these regulations.
(3)
Notwithstanding the fact that a by-election is held, the date of the next main election shall not be affected.
25 Offences
(1)
Every person commits an offence and is liable on conviction to a fine not exceeding $5,000 who contravenes or fails to comply with regulation 9(3).
(2)
Every returning officer or scrutineer or person assisting any such person commits an offence, and is liable on conviction to a fine not exceeding $5,000, who is guilty of any wilful or negligent act of commission or omission contrary to the provisions of these regulations in respect of any election.

26 Appointment of members of New Zealand Fish and Game Council
(1)
The first meeting of each newly elected Fish and Game Council shall be held not later than 3 weeks after the date the members came into office.
(2)
At the first meeting of the Council members shall appoint one of their number to be a member of the New Zealand Fish and Game Council.
(3)
The appointment shall be by majority vote of the Council.
(4)
Members of the New Zealand Fish and Game Council shall remain in office as long as they remain members of the appointing Fish and Game Council, except that where a majority of the members of the appointing Fish and Game Council pass a resolution that a vote be taken on a new appointment prior to expiry of the term, then a vote shall be taken and the successor shall serve out the remaining period of the term.
Transitional provisions
27 Rolls for first election
(1)
The following persons shall be deemed to have indicated their desire to vote at the first election of the appropriate Fish and Game Council:
(a)
all persons who applied for membership of an Acclimatisation Society on purchasing a 1989–1990 adult whole season fishing licence or a 1990 adult whole season game licence:
(b)
all persons who purchased a 1989–1990 adult whole season fishing licence or a 1990 adult whole season game licence, being a licence issued in respect of the Central North Island Wildlife Conservancy area or the Southern Lakes Acclimatisation District area.
(2)
So far as is practicable, the names of all persons referred to in subclause (1) shall be entered on the appropriate roll.
28 Public notice of first election
(1)
Public notice of the first election for each Fish and Game Council shall be given in accordance with regulation 8.
(2)
Every public notice of the first election of a Fish and Game Council shall also include the enrolment form set out in Schedule 4.
(3)
Any person who is eligible to vote in such an election but was not a member of an Acclimatisation Society during the 1989–1990 fishing season or the 1990 game season, and any person who is eligible to vote in such an election and was a member of an Acclimatisation Society during one of those seasons but is not enrolled for the election, may enrol for the election by completing and returning the enrolment form printed as part of the public notice.
(4)
The enrolment form shall be returned to the appropriate returning officer within the period of 1 month specified in regulation 5(1).
(5)
The New Zealand Fish and Game Council shall write to the organisations listed in Schedule 5 at least 60 days before the first election—
(a)
informing such organisations that the first election is to be held; and
(b)
requesting that they inform their members accordingly and advise their members of the contents of the public notice under regulation 8.

1 General
This is a consolidation of the Fish and Game Council Elections Regulations 1990 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
Section 78 of the Legislation Act 2019 provides that this consolidation, published as an electronic version, is an official version. A printed version of legislation that is produced directly from this official electronic version is also an official version.
3 Editorial and format changes
