Pursuant to section 54 of the Customs and Excise Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, and being of the opinion that the prohibition effected by this order is necessary in the public interest, makes the following order.
Order
1 Title
This order is the Customs Import Prohibition (High-power Laser Pointers) Order 2013.
2 Commencement
This order comes into force on 1 March 2014.
Order: confirmed, on 12 December 2014, by section 9(c) of the Subordinate Legislation (Confirmation and Validation) Act 2014 (2014 No 70).
3 High-power laser pointers prohibited from import
(1)
The importation of high-power laser pointers is prohibited, except with the consent of, and subject to such conditions (if any) not inconsistent with this prohibition as may be imposed by, the Director-General of Health.
(2)
In subclause (1), high-power laser pointer means a device that,—
(a)
in the Director-General of Health’s opinion, is of the kind commonly known as a laser pointer; and
(b)
is battery operated; and
(c)
is designed or intended to be operated while held in the hand; and
(d)
produces a coherent beam of optical radiation of low divergence; and
(e)
has a power output of greater than 1 milliwatt.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 March 2014, prohibits the import of high-power laser pointers. High-power laser pointers may imported only with the consent of the Director-General of Health.
Under section 54(5)(b) of the Customs and Excise Act 1996, this order expires on the close of 31 December 2014 unless it is expressly confirmed by an Act of Parliament passed before that date. If confirmed in that way, this order expires on the close of 28 February 2017, as provided by section 55 of the Customs and Excise Act 1996.
