Present:
Her Excellency the Governor-General in Council
This order is made under section 22 of the New Zealand Business Number Act 2016—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Small Business and Manufacturing made after having regard to the matters set out in section 22(2)(b) of that Act.
Order
1 Title
This order is the New Zealand Business Number Order 2025.
2 Commencement
This order comes into force on 12 June 2025.
3 Principal Act
This order amends the New Zealand Business Number Act 2016.
4 Schedule 4 amended
(1)
(2)
In Schedule 4, Parts 1 and 2, replace the item relating to whether the entity is a Māori entity with:
Whether the entity is a Māori entity. This means an entity that—
(a)
is a Māori individual; or
(b)
has 1 or more members or shareholders who are Māori individuals; or
(c)
is a partnership (within the meaning of section 8(1) of the Partnership Law Act 2019) in which 1 or more of the partners are Māori individuals; or
(d)
is wholly or partly owned by a company that has 1 or more shareholders who are Māori individuals
Nicola Purvis,
Acting Clerk of the Executive Council.
Explanatory note
This note is not part of the order but is intended to indicate its general effect.
This order, which comes into force on 12 June 2025, amends the lists of primary business data in Schedule 4 of the New Zealand Business Number Act 2016. The primary business data listed in that schedule consists of information that an entity may choose to have included about it on the New Zealand Business Number Register (the register). An entity may also choose to have that information made publicly available.
There are 2 amendments. The first allows an entity to choose to have its payment bank account name included on the register. It may already choose to have the number of that bank account included.
The second amendment relates to whether the entity is a Māori entity. Currently, an entity may choose to have that information included on the register with the factors that indicate that it is a Māori entity. The amendment no longer requires those factors to be included and instead defines what Māori entity means for the purposes of the register.
Issued under the authority of the Legislation Act 2019.
Date of notification in Gazette: 15 May 2025.
This order is administered by the Ministry of Business, Innovation, and Employment.
