Pursuant to section 36(1) of the Energy Efficiency and Conservation Act 2000 and section 22 of the Standards Act 1988, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the recommendation of the Minister of Energy (having satisfied the requirements of section 36(2) of the Energy Efficiency and Conservation Act 2000), makes the following regulations.

Regulations
1 Title
These regulations are the Energy Efficiency (Energy Using Products) Amendment Regulations 2008.
2 Commencement
These regulations come into force on 1 April 2008.
3 Principal regulations amended
These regulations amend the Energy Efficiency (Energy Using Products) Regulations 2002.
4 Schedules 1 and 2 amended

(1) Schedule 1 is amended as specified in Part 1 of the Schedule of these regulations.
(2) Schedule 2 is amended as specified in Part 2 of the Schedule of these regulations.

Omit the item relating to household refrigerating appliances and substitute:

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 April 2008, amend the items relating to—
household refrigerating appliances, single-phase ducted air conditioners and air-to-air heat pumps, single-phase non-ducted air conditioners and heat pumps, and three-phase air conditioners and heat pumps in Schedule 1 of the Energy Efficiency (Energy Using Products) Regulations 2002; and
household refrigerating appliances and single-phase non-ducted air conditioners and air-to-air heat pumps in Schedule 2 of the Energy Efficiency (Energy Using Products) Regulations 2002.
The amendments re-incorporate by reference the minimum energy performance standards and testing standards relevant to the energy-using products specified above to account for recent revisions to these standards. These standards apply in the form that they existed on 1 April 2008.
