This order is made under section 51(3)(a) of the Public Service Act 2020 on the advice and with the consent of the Executive Council.
Order
1 Title
This order is the Public Service (Chief Executive for School Property) Order 2024.
2 Commencement
This order comes into force on 16 December 2024.
3 Principal Act
Clause 5 amends the Public Service Act 2020.
4 Interpretation
In this order, unless the context otherwise requires, board has the same meaning as in section 10(1) of the Education and Training Act 2020.
5 Schedule 5 amended
In Schedule 5, insert in its appropriate alphabetical order:

6 Functional chief executive role of Chief Executive for School Property
For the purposes of section 51(4)(a) to (c) of the Public Service Act 2020,—
(a)
the designation of the functional chief executive role to which this order relates is Chief Executive for School Property; and
(b)
the department that will be the host department for that role is the Ministry of Education; and
(c)
the particular functions of the role to be carried out within the host department are leading, co-ordinating, and managing the delivery of the property-related operational responsibilities of the Crown in respect of school property, the education estate, education assets, and the schooling network, and those functions include, but are not limited to,—
(i)
making decisions about investment in, and disinvestment of, school property, the education estate, and education assets; and
(ii)
developing and implementing investment and maintenance programmes; and
(iii)
developing and implementing operational policy; and
(iv)
advising Ministers, public service agencies, other government organisations, boards, and other key stakeholders; and
(v)
maintaining relationships with boards and other key stakeholders.

Explanatory note
This note is not part of the order but is intended to indicate its general effect.
This order, which comes into force on 16 December 2024, is made under the Public Service Act 2020 (the principal Act) and relates to the establishment of a new functional chief executive role, designated as the Chief Executive for School Property, to be hosted by the Ministry of Education.
The order amends the principal Act by inserting the name of the new role and that of its host department into Schedule 5 (functional chief executives and host departments) and sets out the particular functions of the role to be carried out within the host department.
