Subpart 3—Key principles relating to functions, powers, and duties

14 Te Mana o te Wai: meaning, application, effect
Meaning and application

(1)

In this Act, Te Mana o te Wai—

(a)

has the meaning set out in the National Policy Statement for Freshwater Management (as that term is defined in section 5 of this Act); and

(b)

applies, for the purposes of this Act, to water (as that term is defined in section 2(1) of the Resource Management Act 1991).

Effect

(2)

When exercising or performing a function, power, or duty under this Act, a person must give effect to Te Mana o te Wai, to the extent that Te Mana o te Wai applies to the function, power, or duty.
