This order is made under section 2 of the Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025 on the advice and with the consent of the Executive Council.

This order is the Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025 Commencement Order 2026.
2 Commencement of Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025
The Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025 comes into force on 6 March 2026.

This note is not part of the order but is intended to indicate its general effect.
This order brings the Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025 into force on 6 March 2026.
The principal effect of the amendments to the Overseas Investment Act 2005 that are made by the Overseas Investment (National Interest Test and Other Matters) Amendment Act 2025 is to introduce a new national interest pathway, with the aim of consenting lower-risk applications more quickly, while managing risk to the national interest.
Date of notification in Gazette: 5 February 2026.
