Proposed amendments
Hone Harawira, in Committee, to move the following amendments:
Clause 7: new section 17
To add the following subsection as subsection (2):
“(2) The person taking the oath may, at that person’s discretion, make before the words of imprecation, the following statement:
English form I will uphold the Treaty of Waitangi. Maori form Ka whakaūngia e au te Tiriti o Waitangi.
Clause 7: new section 18
To add the following subsection as subsection (2):
“(2) The person taking the oath may, at that person’s discretion, make before the words of imprecation, the following statement:

Clause 7: new section 19
To add the following subsection as subsection (2):

To add the following subsection as subsection (2):

Clause 10
To add the following subclause as subclause (2):
(2) Regulation 3 of the Defence Regulations 1990 is amended by inserting the following subclause after subclause (1):
“(1A) The person taking the oath may, at that person’s discretion, make before the words of imprecation, the following statement:”

To add the following subclause:
(3) Schedule 1 of the Citizenship Act 1977 is amended by adding the following note:
““Note: The person taking the oath may, at that person’s discretion, make before the words of imprecation, the following statement:”

Clause 12
To add the following subclause as subclause (2):
(2) Clause 14 of Schedule 7 of the Local Government Act 2002 is amended by adding the following subclause:
“(4) The person making the declaration may, at that person’s discretion, make at the conclusion of that declaration, the following statement:”

Clause 13
To add the following subclause as subclause (2):
(2) Section 37 of the Police Act 1958 is amended by inserting the following subsection after subsection (1):
“(1A) The person taking the oath may, at that person’s discretion, make before the words of imprecation, the following statement:”

To add the following subclause as subclause (2):
(2) Form 49 of Schedule 1 of the Summary Proceedings Regulations 1958 is amended by adding the following note:

Clause 15
To insert the following subclause after subclause (1):
(1A) Section 10 of the Environment Act 1986 is amended by inserting the following subsection after subsection (1):
“(1A) The person taking the oath may, at that person’s discretion, include a statement to uphold the Treaty of Waitangi.”
Clause 16
To insert the following subclause after subclause (1):
(1A) Section 10 of the Ombudsmen Act 1975 is amended by inserting the following subsection after subsection (1):
“(1A) The person taking the oath may, at that person’s discretion, include a statement to uphold the Treaty of Waitangi.”
Clause 17
To add the following subclause as subclause (2):
(2) Clause 3 of Schedule 3 of the Public Audit Act 2001 is amended by inserting the following subclause after subclause (1):
“(1A) The person taking the oath may, at that person’s discretion, include a statement to uphold the Treaty of Waitangi.”
Clause 18
To add the following subclause as subclause (2):
(2) Section 256 of the Resource Management Act 1991 is amended by adding the following subsection as subsection (2):
“(2) The person taking the oath may, at that person’s discretion, include a statement to uphold the Treaty of Waitangi.”
Explanatory note
This Supplementary Order Paper amends the Oaths Modernisation Bill.
The oaths set out in the bill are amended, in each case, by inserting an optional pledge to uphold the Treaty of Waitangi (te Tiriti o Waitangi).
