Proposed amendments

Hon Paula Bennett, in Committee, to move the following amendments:

Clause 17

New section 285(6)(a): to insert after “subsection (5)(b)” (line 20 on page 21) “, (ba),”.

Clause 29A

To insert the following subclause as subclause (1) (after line 9 on page 45):

  • (1) Section 316(2)(a) is amended by omitting “311(2)” and substituting “311(2A)”.

Clause 30

New section 319A(1)(c): to omit “311(2)” (line 30 on page 45) and substitute “311(2A)”.

Clause 31

To insert the following subclause after subclause (2) (after line 28 on page 47):

  • (2A) Section 320(2) is amended by omitting “311(2)” and substituting “311(2A)”.

Clause 39C

To insert after “section 445B” (line 6 on page 52) “(2)”.

Explanatory note

This Supplementary Order Paper sets out amendments to the Children, Young Persons, and Their Families (Youth Courts Jurisdiction and Orders) Amendment Bill. One ensures that new section 285(6)(a) (substituted by clause 17) includes a reference to section 285(5)(ba) (on sentences of home detention) inserted on 1 October 2007 by section 58 of the Sentencing Amendment Act 2007. Another makes it clear that clause 39C amends subsection (2) of section 445B. The rest correct cross-references to new section 311(2A) (substituted by clause 28).
