Motor Vehicle Sales Amendment Bill

Proposed amendments

Hon John Boscawen, in Committee, to move the following amendments:

Clause 2

To omit “the day after the date on which it receives the Royal assent” (lines 4 and 5 on page 2) and substitute “1 October 2010”.

Clause 13

To omit “(1)” (line 10 on page 7) and substitute “(1A)”.

To omit “(1A)” (line 11 on page 7) and substitute “(1B)”.

Clause 19: new section 107(1)(a)

To insert after “false statutory declaration” (line 23 on page 9) “or certificate”.

Schedule: amendments relating to Consumer Information Standards (Used Motor Vehicles) Regulations 2008

Item relating to regulation 7(3): to omit “trader” (line 20 on page 12) and substitute “motor vehicle trader”.

First item relating to Schedule 2: to omit “trader” (line 31 on page 12) and substitute “motor vehicle trader”.

Second item relating to Schedule 2: to omit “trader's” (line 33 on page 12) and substitute “motor vehicle trader's”.

Third item relating to Schedule 2: to omit “traders” (line 1 on page 13) and substitute “motor vehicle traders”.

To add after the last item (after line 1 on page 13):

Schedule 2: omit both paragraphs under the heading Motor vehicle trader registration number and substitute:

“The motor vehicle trader must state the registration number or other unique identifier given to the motor vehicle trader upon registration.”

Explanatory note

This Supplementary Order Paper makes the following changes to the Motor Vehicle Sales Amendment Bill:

  • the commencement date is changed from the day after Royal assent to 1 October 2010:

  • a number is corrected:

  • a reference to a certificate (referred to in new section 40A) is inserted in the offence provision in new section 107:

  • references in parts of the Consumer Information Standards (Used Motor Vehicles) Regulations 2008 to “traders” are changed to references to “motor vehicle traders”, for clarity.
