Misuse of Drugs Amendment Bill
Proposed amendment
Hon Heather Roy, in Committee, to move the following amendment:
New clause 3A
To insert the following clause before clause 4 (after line 14 on page 2):
3A New sections 4C to 4E inserted
The following sections are inserted after section 4B:
“4C Age restriction notice
The Minister may, by notice in the Gazette, specify any substance, preparation, mixture or article as an age-restricted drug.
“4D Effect of age restriction notice
An age-restricted drug can only be sold to people over the age of 18.
“4E Penalties for breaching age restriction
Retailers or distributors that breach the age restriction applying to drugs under the Act face a penalty of—
“(a) $10,000 for the first offence:
“(b) $25,000 for the second offence:
“(c) $50,000 for the third and subsequent offence:
“(d) compulsory closure of their premises for 7 days following the third and subsequent offence.”
Explanatory note
This Supplementary Order Paper amends the Misuse of Drugs Amendment Bill so as to enable the sale of certain drugs to be restricted to people aged 18 or over.
