Medicines Amendment Bill
Proposed amendment
Hon Todd McClay, in Committee, to move the following amendment:
New clause 37A
After clause 37 (after line 4 on page 28), insert:
37A Amendment relating to Legislation Act 2012
(1) This section takes effect on 5 August 2013.
(2) Schedule 3 (as added by section 37 of the Medicines Amendment Act 2011) is amended by omitting clauses 6 and 7 and substituting the following clause:
“6 Application of Legislation Act 2012 to material incorporated by reference
“(1) Part 2 of the Legislation Act 2012 does not apply to material incorporated by reference in regulations in reliance on section 105E or to an amendment to, or replacement of, that material.
“(2) Subpart 1 of Part 3 of the Legislation Act 2012 applies to regulations that incorporate material by reference in reliance on section 105E.
“(3) However, nothing in section 41 of the Legislation Act 2012 requires material that is incorporated by reference in regulations in reliance on section 105E to be presented to the House of Representatives.”
Explanatory note
This Supplementary Order Paper inserts into the Bill a provision that deals with the repeal of the Acts and Regulations Publication Act 1989 and the Regulations (Disallowance) Act 1989 by the Legislation Act 2012. When that repeal comes into force on 5 August 2013, the clauses that refer to the repealed Acts will be replaced by a clause that refers to the new law.
