Judicature Modernisation Bill

Proposed motion to divide Bill into 23 Bills

Hon Amy Adams, in Committee, to move as follows:

That the enacting words, clauses 1 and 2, Part 1, and Schedules 1A to 4 be a separate Bill, and that the enacting words, clauses 1 and 2, and the Part 1 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the Senior Courts Act 2016.

2 Commencement

(1)

This Act comes into force on 1 March 2017.

(2)

Subsection (1) applies with the following exceptions:

(a)

the following provisions come into force on the day after the date of Royal assent:

(i)

section 4, in relation to the definition of High Court Rules:

(ii)

sections 144A to 152:

(iii)

section 171 and 171A:

(iv)

section 179(1AA):

(v)

section 180(c):

(vi)

section 182:

(vii)

Schedule 2:

(viii)

Schedule 3A:

(b)

section 179(3) comes into force on 1 January 2018.

That Part 2 and Schedules 5 to 7 be a separate Bill, and that the Part 2 heading be replaced with:

The Parliament of New Zealand enacts as follows:

1 Title

This Act is the District Court Act 2016.

2 Commencement

(1)

This Act comes into force on 1 March 2017.

(2)

Subsection (1) applies with the following exceptions:

(a)

the following provisions come into force on the day after the date of Royal assent:

sections 419 and 419A:

(ii)

Schedule 5:

(b)

section 420(2) comes into force on 1 January 2018.

2 Commencement

This Act comes into force on 1 March 2017.

That subpart 1 of Part 6 be a separate Bill, and that the Part 6 heading and the subpart 1 heading in Part 6 be replaced with:

This Act is the Arbitration Amendment Act 2016.

2 Commencement

This Act comes into force on 1 March 2017.

2 Commencement
