Proposed amendment
Hon Aupito William Sio, in Committee, to move the following amendment:
New Part 15A
After Part 15 (page 17, after line 30), insert:
Part 15A Food Act 2014
49A Principal Act
This Part amends the Food Act 2014 (the principal Act).
49B Section 289 amended (Publish privileged statements)
Repeal section 289(4).
Explanatory note
This Supplementary Order Paper amends the Statutes Amendment Bill (No 2) to correct an omission in the Food Safety Law Reform Act 2018.
An intention of that Act was to amend the Food Act 2014 to enable a delegate of the Chief Executive of the Ministry for Primary Industries to publish privileged statements for the purpose of protecting human life or public health or informing the public. That intention was only partially achieved. This Supplementary Order Paper enables that intention to be given full effect by removing a restriction on the chief executive’s ability to delegate the power to publish those statements.
Departmental disclosure statement
The Ministry for Primary Industries considers that a departmental disclosure statement is not required to be prepared for this Supplementary Order Paper.
