Social Security (Financial Assistance for Caregivers) Amendment Bill
Proposed amendment
Ricardo Menéndez March, in Committee, to move the following amendment:
New clause 4A
After clause 4 (page 2, after line 6), insert:
4A Section 46 amended (Unsupported child’s benefit: requirements)

In section 46(1), delete “, because of the circumstances specified in subsection 2,”
.

Repeal section 46(2).

After section 46(4), insert:

To avoid doubt, it is not necessary to establish a breakdown in the child’s family for this section to apply.
Explanatory note
This Supplementary Order Paper amends the Social Security (Financial Assistance for Caregivers) Amendment Bill by removing the requirement in the Social Security Act 2018 to prove a breakdown in the family, so caregivers will no longer have to go through Family Court processes before they can receive the benefit. It will also enable whānau with whāngai arrangements to receive the benefit, even if there is no family breakdown.
