Three Strikes Legislation Repeal Bill
Proposed amendments
Hon Kiritapu Allan, in Committee, to move the following amendments:
Clause 2 amended
In clause 2, replace “1 July 2022”
with “the day after the date of Royal assent”
(page 3, line 5).
New clause 20A inserted
After clause 20 (page 5, after line 12), insert:
20A Section 88 amended (Chief executive must determine key dates, etc)
After section 88(3), insert:

A determination made under this section must be made as if the Three Strikes Legislation Repeal Act 2021 had not been enacted.
Schedule: new Part 4
In the Schedule, new Part 4, replace clause 13(2) (page 9, lines 10 to 23) with:

If this clause applies, the person is not eligible for release or re-sentencing as a consequence of any provision brought into force under the Three Strikes Legislation Repeal Act 2021.
Explanatory note
This Supplementary Order Paper changes the commencement date of the Bill from 1 July 2022 to the day after the date of Royal assent. In addition, it inserts new clause 20A, which provides that determinations made under section 88 of the Parole Act 2002 must be made as if the Three Strikes Legislation Repeal Bill were not enacted. As a consequence, it also amends clause 13(2) of new Part 4 of the Schedule to simplify the relevant transitional provision.

The Ministry of Justice considers that a departmental disclosure statement is not required to be prepared for this Supplementary Order Paper.
