Proposed amendments
Hon Chris Hipkins, in Committee, to move the following amendments:
Clause 8
In clause 8, replace new section 39A(1)(a)(ii) (page 4, lines 13 and 14) with:
(ii)
a specified violent offence as defined in section 4 of the Victims’ Orders Against Violent Offenders Act 2014; or
Clause 21
In clause 21, replace new section 111A(2)(a) (page 10, line 8) with:
(a)
a specified violent offence as defined in section 4 of the Victims’ Orders Against Violent Offenders Act 2014; or
Explanatory note
This Supplementary Order Paper sets out amendments to the Firearms Prohibition Orders Legislation Bill.
The amendments replace, in clauses 8 and 21, the references to a serious violent offence as defined in section 86A of the Sentencing Act 2002. This is required because the latter section is replaced by the legislation repealing the three strikes law.
The references are now to a specified violent offence as defined in section 4 of the Victims’ Orders Against Violent Offenders Act 2014. The definition of specified violent offence is the same as the definition of serious violent offence in former section 86A of the Sentencing Act 2002.
