Regulatory Systems (Education) Amendment Bill

Proposed amendments

Hon Erica Stanford, in Committee, to move the following amendments:

Clause 9

Replace clause 9(1) (page 4, line 8) with:

(1)

In section 2, replace the definition of Pacific person with:

Pacific person means a person who is living in New Zealand and who—

(a)

is a New Zealand citizen or has been granted permanent residence or has been permitted to enter New Zealand with the intention of gaining permanent residence; and

(b)

has indigenous Pacific cultural heritage from a place listed in Schedule 2

In clause 9(2), delete the definition of Aotearoa Pacific person (page 4, lines 10 to 16).

Clause 11

In clause 11, new section 5, delete “Aotearoa” (page 5, line 5).

In clause 11, new section 5(a), delete “Aotearoa” (page 5, line 8).

Clause 15

Delete clause 15(1) (page 6, line 6).

Explanatory note

This Amendment Paper amends Part 2 of the Regulatory Systems (Education) Amendment Bill, which makes changes to the Pacific Education Foundation Act 1972 (the principal Act).

Clause 9 is amended to replace the definition of Aotearoa Pacific person proposed to be inserted into section 2 of the principal Act with a definition of Pacific person. The new definition of Pacific person is to the same effect as in the Bill but reverts to the terminology currently used in the principal Act to describe the class of persons eligible for financial assistance under that Act.

Clauses 11 and 15 are consequentially amended to reflect the replacement of the defined term.

Departmental disclosure statement

The Ministry of Education considers that a departmental disclosure statement is not required to be prepared for this Amendment Paper.
