Proposed amendments to AP No 51
Hon Paul Goldsmith, in Committee, to move the following amendments:
Clause 8
After clause 8(a)(iv), insert:
(iva)
a headstone or grave marker erected before the commencement of this Act:
Clause 33B
In clause 33B, new regulation 3(2)(a)(viii), replace “Gangs”
with “Parts 1 to 4 of the Gangs”
.
Schedule 4
In Schedule 4, heading to new Part 5, replace “Gangs”
with “Part 5 of the Gangs”
.
Explanatory note
This Amendment Paper amends AP No 51 to—
insert new clause 8(a)(iva), which provides a further exception to the prohibition on display of gang insignia in a public place where the display is on a headstone or grave marker erected before the commencement of Parts 1 to 4 of the Bill:
make technical adjustments to new regulation 3(2)(a)(viii) of the District Court Fees Regulations 2009 (as amended by clause 33B) and the heading of new Part 5 of Schedule 1AA of the Sentencing Act 2002.

The Ministry of Justice considers that a departmental disclosure statement is not required to be prepared for this Amendment Paper.
