Resource Management (Simplifying and Streamlining) Amendment Bill
Proposed amendments
Dr Russel Norman, in Committee, to move the following amendments:
Clause 68
To insert in new section 95B the following paragraph:
“(4) For the avoidance of doubt, an organisation representing a relevant part of the public interest must be treated as being adversely affected if, in the opinion of the consent authority, the granting of a resource consent may adversely affect that public interest.”

To omit new section 95D(a)(ii).
Explanatory note
This Supplementary Order Paper introduces clarification in section 95B that limited notification must be given to organisations representing the public interest if that public interest is adversely affected.
It also removes new section 95D(a)(ii) in order that a consent authority deciding whether an activity’s adverse effects on the environment are more than minor, must regard any effects on person who own or occupy any land adjacent to the land associated with the application.
